The verdict was issued on Monday (4/8) local time, only a few moments after the Israeli cabinet dominated by the right wing coalition approved the dismissal of Baharav-Miara unanimously.
Minister of Justice Yariv Levin announced the decision through an official letter to Baharav-Miara.He stated that “it should not force himself on a government that does not believe it and cannot work effectively with him”.
However, the decision immediately received resistance.Yesh Atid’s opposition party along with a number of activist groups immediately submitted an emergency petition to the Supreme Court to cancel the dismissal.
One of the lawsuits was filed by The Movement for Quality Government in Israel, the supervisory agency that considers that this dismissal raises conflicts of interest because Baharav-Miara is handling the Netanyahu corruption case.
They called this step an effort to make the position of Attorney General as “political position”.
Responding to the lawsuit, the Supreme Court issued a suspension order, which expressly forbade the government to dismiss Baharav-Miara or appoint a replacement until the hearing was carried out within 30 days.
However, a strong reaction came from the Minister of Communication of Israel, Shlomo Karhi.Through account X, he said he would refuse to follow the court’s decision.
“The successor must be appointed immediately! We obey the law! We told the Supreme Court, no!”Karhi said.
Meanwhile, Baharav-Miara called the government’s move to fire him as an illegal act.
He asserted, “Political pressures and actions that are contrary to the law will not stop us from continuing to carry out our duties with statesmanship, professionalism, and integrity.”
Tension increases
The tension between Baharav-Miara and Netanyahu’s government is not new.Since the right wing government was formed, both of them often disagree, especially related to the judicial reform package that has received great protests since it was announced in 2023.
In March, the Israeli cabinet even held a motion of no confidence in Baharav-Miara.The Netanyahu office accuses the Attorney General to carry out “inappropriate behavior” and mention the “difference in substantial views” that hinder cooperation.
Baharav-Miara denied the accusation.He considered the move as part of an effort to weaken the judiciary in order to expand the power of government and seek fully loyalty to the authorities.
Not only that, Baharav-Miara also opposed Netanyahu’s efforts to fire the Head of the Israeli Domestic Security Agency (Shin Bet), Ronen Bar.The step was then declared “invalid” by the Supreme Court.
The bar, who ended his term of office in June, had led an investigation of the alleged links of people close to Netanyahu with Qatar, in a case that Israeli media referred to as “Qatargate”.
He also rejected special requests from the security forces who tried to free Netanyahu from the obligation to testify in the trial.
Netanyahu himself is facing serious accusations, ranging from bribery, fraud, to violations of public trust.He is suspected of receiving luxury prizes from entrepreneurs in return for profitable media policies and treatment, as well as making political agreements to get positive coverage.
If proven guilty, Netanyahu is threatened with a prison sentence of up to 10 years.
This legal process has been running since 2020, and he was accused of deliberately extending conflict in Gaza to maintain power and avoid punishment.
United States President Donald Trump interfered in this case.He defended Netanyahu and called the prosecutors who demanded him as “out of control”.
Trump even suggested that Israel give forgiveness to Netanyahu, and stated the US could have used its military assistance as a means of pressure.
